These terms and conditions of sale apply to all services and goods supplied through our clinic and this website by Sapphire Medical Aesthetics Ltd (referred to as "SMA/we/our/us"), whose registered office is at Sme House, Holme Lacy Industrial Estate, Hereford, England, HR2 6DR.

By placing an order by telephone with our online shop team, you confirm your unconditional acceptance of these conditions.

You will be able to access most areas of this website without registering your details with us. Certain areas of this website are only open to you if you register.

3. ORDERING FROM US

When you place an order to purchase a product from SMA, we will send you an acknowledgement of your order via email, which will contain the details of your order. Acceptance of your order will not take place until after your payment is taken and you receive your acknowledgement of order email. It is at this point that a binding legal contract is created and any such contract is subject to these terms and conditions. Payment for the products and delivery charges can be made by any method shown on our website at the time you place your order. Payment for the products and delivery charges is taken at the time we receive your order, once we have checked your card details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods we will inform you of this as soon as possible and a full refund will be issued. We may refuse to accept an order where we cannot obtain authorisation for your payment; if there has been a pricing or product description error; or if you do not meet any eligibility criteria set out in our terms and conditions.The completion of sale is subject to the customer agreeing to use the product in accordance with manufacturer's guidelines and recommendations. SMA accepts no responsibility for products other than supply and delivery to the customer. All products should be patch tested before complete use to determine suitability. It is then the customer’s responsibility to determine whether a product is suitable for use on their skin. Whilst advice may be given via telephone or email, SMA cannot be held responsible if a product reacts with your skin. In the instance that a reaction occurs, a reaction form must be completed (from SMA and on some occasions the manufacturer), fully and accurately. This will then be sent on to the product manufacturer and the outcome is at the manufacturers discretion. The best area to do the patch test is somewhere close to where the product is to be applied. Apply a small amount of product on a small area of clean, dry skin. For a face product test behind your ear or on the side of your neck. For a body product test on the inner arms or behind the knee. Allergic reactions typically appear after around 24 hours so monitor closely for any signs of irritation or discomfort. If irritation does appear, wash off the area immediately and do not use the product. All products purchased from SMA must be for personal use only, and are not to be resold.

4 PRODUCTS & PRICING

All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price. Product descriptions and prices may change without notice. Product prices are the same whether purchasing in clinic or through the Internet on our online store. Product descriptions are based on information provided by the manufacturers / distributors. The descriptions relate to individual products and results and reactions on the skin will vary widely depending on other products they are used in conjunction with. It is the customer’s responsibility to patch test any product prior to use, checking compatibility of any purchased products with other medication or treatments. SMA cannot take responsibility for any adverse reactions. The majority of products are in stock, however if due to stock shortage it appears to us that we are unlikely to be able to deliver the products within 5 working days of receipt of your order then we will either contact you within the said 5 working day period to agree a revised date for anticipated delivery of the products or re-credit any sum/s that have been paid by you or debited from your credit card for the products concerned. A confirmation email shall be sent confirming this refund.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction over these terms and that you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland this applies to either the Scottish or the English courts and if you live in Northern Ireland to either the Northern Irish or the English courts.

We do not warrant that materials/items for sale on the website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
